Welcome to KeepGoing! These Terms of Service ("Terms") govern your use of the KeepGoing fitness tracking application. By creating an account or using KeepGoing, you agree to these Terms.

1. Acceptance of Terms

3. User Accounts

Account Creation

To use KeepGoing, you must:

• Be at least 13 years of age
• Provide a valid email address
• Create a secure password
• Provide accurate information

Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Account Termination

You may delete your account at any time through the Settings page. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Conduct

You agree NOT to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to the service or other users' accounts
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the service or servers
• Reverse engineer, decompile, or disassemble the application
• Use automated scripts or bots to access the service
• Impersonate another person or entity
• Collect or harvest user data without permission

5. Your Content and Data

Ownership

You retain all rights to your workout data and content. By using KeepGoing, you grant us a license to store and process your data solely for the purpose of providing the service.

Data Accuracy

You are responsible for the accuracy of the data you enter. KeepGoing is not responsible for errors or inaccuracies in your workout logs.

Data Backup

While we maintain regular backups, you are encouraged to keep your own records of important data. We are not liable for data loss.

6. Intellectual Property

KeepGoing and its content (excluding user data) are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the application
• Use our trademarks without permission
• Create derivative works based on KeepGoing

7. Health and Medical Disclaimer

IMPORTANT: KeepGoing is a tracking tool, not medical advice.

• Always consult a healthcare professional before starting any exercise program
• The app's insights and recommendations are for informational purposes only
• We are not responsible for any injuries or health issues resulting from your use of the service
• Exercise recommendations (like rest days) are general guidelines, not personalized medical advice
• Listen to your body and seek professional guidance for health concerns

8. Service Availability

We strive to provide reliable service, but we do not guarantee:

• Uninterrupted access to KeepGoing
• Error-free operation
• That the service will meet all your requirements

We may modify, suspend, or discontinue the service at any time with reasonable notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• KeepGoing is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed $100 or the amount you paid us (if any) in the past 12 months
• We are not liable for data loss, service interruptions, or security breaches beyond our control

10. Indemnification

You agree to indemnify and hold harmless KeepGoing and its operators from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of others

Your use of KeepGoing is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

KeepGoing uses third-party services for:

• Supabase - Database and authentication
• Netlify - Web hosting
• Resend - Email delivery

Your use of these services through KeepGoing is subject to their respective terms and privacy policies.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will:

• Update the "Last Updated" date
• Notify users through the app or email
• Provide a reasonable notice period before changes take effect

Continued use of KeepGoing after changes constitutes acceptance of the new Terms.

14. Termination

By You

You may stop using KeepGoing and delete your account at any time through the Settings page.

By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the service or harm other users

Effect of Termination

Upon termination:

• Your access to KeepGoing will end immediately
• Your data will be deleted in accordance with our Privacy Policy
• Sections of these Terms that naturally survive (like limitation of liability) will continue to apply
